- babeery, a Moroccan company specialized in the design and sale of children’s clothing, hereinafter referred to as “Seller,” whose registered office is at 100 Lot Riad Azzaitoun, R.A.C Magasin 2, Fes, Morocco.
- Customer, hereinafter referred to as “Buyer,” any natural or legal person who places an order through the Seller’s online store at babeery.ma.
Subject Matter
The Seller undertakes to sell and deliver the children’s clothing items specified in the Buyer’s purchase order, and the Buyer undertakes to purchase and pay for those items under the terms and conditions of this Contract.
Definitions
- “Products”: The garments and accessories offered for sale in the Seller’s online store.
- “Purchase Order”: The electronic form submitted by the Buyer specifying the Products, quantities, sizes, and delivery address.
- “Order Confirmation”: The email sent by the Seller acknowledging receipt and acceptance of the Purchase Order.
Formation of the Contract
- The Buyer completes and submits the Purchase Order via the website.
- The Seller reviews the order and issues an Order Confirmation to the Buyer.
- This Contract becomes legally binding on both Parties upon issuance of the Order Confirmation.
Price and Payment
- Product prices are quoted in Moroccan Dirhams (MAD) and include applicable taxes unless otherwise stated.
- The Buyer must pay the full order amount at the time of order placement using one of the approved payment methods (credit card, bank transfer, or secure online payment gateway).
- In the event of payment failure, the Seller may cancel the order after notifying the Buyer within three (3) business days.
Delivery and Transfer of Risk
- The Seller will deliver the Products to the address specified in the Order Confirmation within an estimated timeframe of two (2) to five (5) business days, unless otherwise agreed.
- The risk of loss or damage to the Products passes to the Buyer upon physical receipt.
Inspection and Acceptance
- The Buyer must inspect the Products immediately upon receipt and report any visible defects within forty-eight (48) hours.
- Failure to report defects within this period constitutes unconditional acceptance of the Products.
Returns and Exchanges
- The Buyer may return or exchange unused Products in their original condition and packaging within thirty (30) days of delivery, in accordance with the separate Returns & Exchanges Policy posted on the Seller’s website.
- Return shipping costs are borne by the Seller only if the error is attributable to the Seller; otherwise, they are borne by the Buyer.
Warranty
- The Seller warrants that the Products are free from manufacturing defects at the time of delivery.
- Warranty claims must be submitted within fourteen (14) days of discovering the defect, accompanied by proof of purchase and, if possible, illustrative photographs.
Seller’s Liability
- The Seller’s liability for direct damages arising from a breach of this Contract is limited to the purchase price of the affected Products.
- The Seller shall not be liable for any indirect or consequential damages.
Confidentiality and Data Protection
Both Parties agree to maintain the confidentiality of all shared information and to comply with babeery’s Privacy Policy in respect of personal data.
Force Majeure
Neither Party shall be liable for delays or failure to perform any obligation under this Contract due to events beyond its reasonable control, including natural disasters, wars, or labor strikes.
Governing Law and Dispute Resolution
This Contract shall be governed by the laws of the Kingdom of Morocco. Any dispute arising out of or in connection with this Contract shall be submitted to the competent courts of Fes, Morocco.
By placing an order and receiving the Order Confirmation, the Buyer acknowledges having read, understood, and agreed to all the terms and conditions of this Contract.
